Assistance with real property projects

We specialise in assisting with the tax aspects of real property projects, from the planning phase to the completion phase. In the planning phase, the focus is on producing a tax plan. We check this plan for the parties concerned, to ensure that the tax outcome is correct. During the course of a real estate project, our advice is constantly updated in consultation with the client to include any changes in the situation. If necessary, we will consult with the Dutch Tax & Customs Administration (TCA: Belastingdienst) to obtain specific rulings.

Structuring of VAT & real property transfer tax for multinationals and company takeovers

The way a (multinational) group is structured determines its tax position. We have extensive experience with analysing such groups in terms of the best possible tax position. An aspect that is often relevant here is the “VAT group”. We also have extensive experience with advising on the consequences of intercompany transfer transactions, both within the Netherlands and cross-border.

VAT analysis of companies and non-profit organisations

We have extensive experience in conducting VAT analyses for companies and organisations, particularly including those that are unable to deduct all the VAT they have paid as input tax. For these “mixed” companies and organisations, other important tax aspects are the calculation (and checking) of the “integration” VAT on real property, and the “adjustment” of VAT on movable and real property. At DHK we have developed our own method for reporting the calculations in an efficient and verifiable format to the client and the Dutch Tax & Customs Administration (TCA: Belastingdienst), as the basis for the refund of pro rata VAT.

Proceedings at district court, appeal court, Supreme Court of the Netherlands and European Court of Justice

In practice, a difference of opinion can sometimes arise with the Dutch Tax & Customs Administration (TCA: Belastingdienst). If it proves impossible to resolve this difference of opinion by discussion, it can be necessary and/or desirable to commence tax proceedings. These proceedings start with the submission of a letter of objection to the TCA (within the applicable time limit) against an additional VAT assessment or your own VAT return. On the basis of this letter of objection, the TCA will have to reconsider the assessment or return. DHK can also assist you in this early “preliminary stage”.
